This End User License Agreement (“EULA”) constitutes a valid and binding agreement between you, as the end-user, and Neirfeno Limited (SC514019), registered in Scotland at 45 Rankine Street, Dundee, DD3 6DY, for the use of the Enriched platform. Please review the EULA carefully before using.
Acknowledgement
By agreeing to use Enriched, you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, you must immediately discontinue its use.
License
Subject to the terms of this EULA, Neirfeno Limited grants you a non-exclusive and non-transferrable licence to use Enriched.
Restrictions on Use
You agree not to, and will not permit others to: (a) license, sell rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit Enriched or make it available to any third party; (b) copy or use the platform for any other purpose other than as permitted in Section 2; (c) remove or alter any propreitary notices or labels on the system.
Intellectual Property
The platform, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of Neirfeno Limited.
Privacy
Your use of the Platform is subject to Neirfeno Limited’s Privacy Policy, which is available at https://enriched.com/privacy-policy (as may be updated from time to time)
Changes to this EULA
Neirfeno Limited reserves the right to modify this EULA at any time, and without prior notice, by posting an amended EULA that is always accessible through the Platform. Your continued use of the Platform indicates your acceptance of the amended EULA.
Termination
This EULA will continue to be in force until the earlier (a) termination by you (by ceasing to use the platform), or (b) termination by Neirfeno Limited. Upon termination of this EULA, you must discontinue all use of the Platform.
Disclaimers
The platform is provided “AS IS” and “AS AVAILABLE” basis. Neirfeno Limited disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
In no event will Neirfeno Limited be liable for any indirect, special, incidental, or consequential damages, that are directly or indirectly related to the use of, or the inability to use, the Platform, even if Neirfeno Limited has been advised of the possibility of such damages.
Governing Law
This EULA will be governed by and construed in accordance with the laws of Scotland, without regard to conflict of law principles.
By using the Enriched platform, you confirm that you accept this EULA and that you agree to comply with them.
